Zofran has never been approved by the FDA for use in pregnant women, according to court documents. Furthermore, the case alleges that GlaxoSmithKline has never engaged in clinical research to determine whether the drug is safe for pregnant women or their developing fetuses, according to court documents.

In 2012, Zofran‘s marketer, GlaxoSmithKline, entered civil settlements with the U.S. Department of Justice for the illegal marketing of pharmaceutical drugs, including the marketing of Zofran for use in pregnant women, according to court documents. The company paid $1 billion in civil settlements, according to court documents.
