Wednesday, May 27, 2015 - In recent Xarelto lawsuit news, attorneys handling cases that have been consolidated as part of MDL 2592 report the adoption of a digital system for the service and distribution of court documents amongst the plaintiffs‘ counsel.* This decision was announced in Pretrial Order 17, which was filed on May 21, 2015.
The digital service, the BrownGreer MDL Centrality system, will be used to distribute pleadings and discovery documents to the plaintiff‘s counsel only, ordering to the Order, an official court document. Defendants‘ counsel has not opted to make use of this service; therefore defendants‘ counsel will not have access to the system and court documents must be served in the traditional manner. The MDL Centrality system provides for the electronic storage, service, and delivery of court documents through a secure website.
"Using a digital system for court documents promotes ease of access, allows counsel to search court documents at any time, and promotes efficiency. Not all MDLs make use of this technology, but it certainly is a growing trend to use the available resources to conserve resources and time. The system relies on a secure central website where all court documents are uploaded, according to the court document. Each participating party receives an email notifying them of the availability of a new document, and each plaintiff‘s counsel using a unique username and password to log into the system and access the documents. Ordinary Confidentiality and Protective Orders apply to these documents. Once the system is in place, the Plaintiffs‘ Co-Liaison Counsel is no longer required to serve and distribute court documents related to the case. Parties that do not register for the service will no longer receive court documents.
As of May 27, 2015, there are currently 434 Xarelto lawsuits pending as part of MDL 2592, known as Xarelto (Rivaroxaban) Products Liability Litigation. The actions were consolidated in the Eastern District of Louisiana for pretrial proceedings in December of 2014 on the basis of common facts.
