What is Multidistrict Litigation?

Complex cases that involve numerous injured plaintiffs across the United States are often consolidated into an MDL (multidistrict litigation). This type of lawsuit allows for numerous injured victims to share certain aspects of litigation, while still maintaining their individual lawsuits against a company or corporation for varying degrees of damages. Disaster cases or cases against large drug companies are prime examples of multidistrict litigation at its best.

When is a Multidistrict Lawsuit Needed?

When hundreds and thousands of Americans are injured or harmed by a defective product, a disaster, or a dangerous drug, the result could be years of costly litigation, monopolizing court systems across numerous states. In order to better manage these individual civil cases, and streamline the litigation process, multidistrict litigation is used.

In multidistrict litigation, multiple civil cases in numerous states are transferred to a single district court. The Judicial Panel on Multidistrict Litigation decides which cases can be consolidated under the specific MDL and those cases can then share all discovery and pretrial proceedings. In order for your case to qualify to be part of the multidistrict litigation, it must have similar facts in common with the other cases.

Advantages of a Multidistrict Lawsuit

There are numerous advantages to multidistrict lawsuits. Once a case is consolidated under an MDL, the plaintiffs share all pretrial proceedings and discovery, as well as expert testimony, which cut litigation expenses drastically. Multidistrict litigation saves both parties considerable time and money, and offers a streamlined and organized way to settle complex lawsuits.

Yet unlike a class action lawsuit, each lawsuit is allowed to be settled individually or proceed to trial with the jury ultimately deciding on an appropriate settlement amount per victim. This ensures that victims who have suffered extraordinarily will receive damages that are tailored to their case—and their injuries.

In class action lawsuits, one settlement is split between all plaintiffs in the lawsuit equally. This means that each injured victim only receives a small fraction of the large settlement – which is usually far below what they truly need and deserve.

Multidistrict Litigation Leadership Roles

Attorneys across the country often take an active leadership role in multi-district litigation and may be chosen to be a part of the plaintiffs' steering committee and executive committee. After forming a MDL, it becomes necessary to reduce the number of attorneys involved in the cases. When this occurs, a small number of attorneys are retained to oversee the entire litigation process. This is known as the Plaintiff's Steering Committee (PSC).

A separate committee, known as the Plaintiff's Executive Committee, is then formed from separate attorneys to help coordinate the activities of the PSCs. This keeps the litigation on track and ensures that the MDL process runs smoothly.

Banding Together to Hold Negligent Manufacturers Responsible

Drug companies and medical device manufacturers routinely put profits before people. They push off-label uses of their drug, rush improperly tested drugs to market, and then deny side effects and complications when they occur. Even worse, they do this time—and time again.

When this occurs, injured consumers can—and should—hold them accountable and make them take responsibility for their transgressions. Multi-district litigation not only allows injured victims and their families to hold these corrupt manufacturers responsible, but also ensures that these dangerous products are recalled, so that future injuries and deaths may be avoided.
